The Supremes cannot deliver a remedy as there are too many parties involved. They have the worst time interpreting the Commerce Clause as well as the Takings Clause to the Fifth Amendment to the Bill of Rights. For example, horses are shipped to foreign Countries to be slaughtered for dinner. There have been several attempts to ban the slaughter of US horses in Canada, Japan, and Mexico. They will not grant the Writ if it involves the Commerce Clause. That is how it has been with the horses. They just do not like the commerce clause and this situation as described in the article extends itself to that. They have a tough road ahead of them.
